Purpose of Job

 

The Director, Investigations is an integral part of the OCCO leadership team. The Director, Investigations is responsible for managing Bank investigations into allegations of staff misconduct under the Bank’s Conduct and Disciplinary Rules and Procedures (CDRPs); and allegations of Prohibited Practice by Bank counterparties under the Bank’s Enforcement Policy and Procedures. They also are responsible for establishing and maintaining OCCO’s knowledge management initiative. 

 

The Director, Investigations ensures that the Bank builds and maintains appropriate resources and expertise and has effective policies and procedures to respond to allegations of staff misconduct or fraud and corruption by Bank counterparties. 

 

The Director, Investigations is responsible for developing and maintaining effective liaison with key stake-holders in other international organisations and national authorities and promotes the Bank’s investigative functions both within the Bank and in the wider international organisation community.

 

Within this context, the principal roles of the Director, Investigations are:

  • to effectively manage Bank’s investigation function; and to ensure that the Bank develops and maintains effective policies, resources and expertise to respond to allegations of staff misconduct or fraud and corruption by its counterparties.
  • to supervise and review the work of other Bank investigators as well as the work external contractors engaged to undertake investigations on the Bank’s behalf. 
  • to provide strategic guidance given by OCCO on banking projects, such as in relation to integrity clauses and capacity building initiatives, to protect the Bank against fraud and corruption. 
     

The Director, Investigations builds and maintains relationships with the investigative departments in the other MDBs as well as with relevant national authorities. The role is expected to engage in policy dialogue with other MDBs and to represent the Bank and make presentations at international conferences and workshops. 

The role supervises the other OCCO investigative personnel and the OCCO knowledge management function. 

The Director, Investigations is also required to assist the MD, CCO with certain strategic tasks, including: facilitating an effective professional and enabling environment within OCCO; completing OCCO operational requirements, such as responding to internal audit findings; and oversighting OCCO’s budget. 

 

Accountabilities & Responsibilities

 

  • Accountable to, and supervised by, the MD, CCO.
  • Manages the resources and workload associated with the Bank’s investigation function, in accordance with the requirements of the EPPs and CDRPs, and OCCO’s knowledge management function;
  • Leads and manages staff in OCCO and ensures efficient, effective and consistent performance by these personnel;
  • Ensure that all Bank investigations are completed within the expected timeframe and investigation reports are completed to a high standard. Ensures that investigative findings and conclusions are appropriate and sufficiently supported;
  • Leads and assists with high-level dialogue and cooperation with other multinational development institutions and international organisations in areas of ethics, investigations, anti-corruption and compliance. Actively contributes to international cooperation designed to further combat corruption and fraud in MDB programmes. 
  • Oversees the implementation of cross debarment under the EPPs or in the context of the Multilateral Development Banks’ Agreement for the Mutual Enforcement of Debarment Decisions;
  • Provide substantive input to the MD, CCO and Director, Policy and Ethics and Director, Project Integrity with regard to development of Bank policies and procedures;
  • Lead special initiatives/projects and to undertake other ad hoc assignments;
  • Directly accountable for the engagement and effective overall management of staff including recruitment, compensation (as agreed with the MD, CCO, if applicable), performance management, coaching and development;
  • Champion and role model the Bank’s Behavioural Competencies and Corporate Behaviours, ensuring adherence within the team(s) so that the highest standards of integrity and ethical conduct are exhibited at all times.

 

Knowledge, Skills, Experience & Qualifications

 

  • A postgraduate degree in law (LLM or JD) or Master’s degree in a relevant area (finance, banking, accounting)
  • Considerable relevant professional experience with appropriate degree of seniority.
  • Acknowledged within the international community as being of impeccable standing, both professionally and personally.
  • Proven expertise in conducting and managing complex investigations within the context of international organisations.
  • Successful leadership of diverse teams and practice areas in a multi-national environment. 
  • Ability to lead or direct and coordinate the decision-making processes in public and private organisations.
  • Exemplary advocacy and liaison skills, established peer network and proven ability to communicate with and manage EBRD stakeholders.
  • Track record of investigation policy development, including negotiations with IFIs and internationally, more generally.
  • Thorough understanding of EBRD’s mission and mandate.
  • Experience of the investigation and integrity processes applicable to an IFI.
  • Ability to manage budgets.
  • Excellent command of English with ability to communicate clearly and concisely; familiarity with other languages used in the Bank’s countries of operation is a definite advantage.
